Introduction

These Terms of Service ("Terms") are a legally binding agreement between you and True Contracting LLC ("Company," "we," "us," or "our") governing your access to and use of the Bible Family Journal mobile application, related websites, content, features, subscriptions, and services (collectively, the "Service").

By downloading, accessing, creating an account for, purchasing a subscription to, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Authority

The Service is designed for family use and may be used by children under the supervision of a parent or legal guardian. Only a parent, legal guardian, or other adult with legal authority may create an account, purchase a subscription, submit a child's information, or agree to these Terms for use of the Service.

By creating an account, purchasing a subscription, or using the Service as the account holder, you represent that you are an adult with legal authority to accept these Terms for yourself and, if applicable, for each child using the Service through your family account.

You may create or manage a profile for a child, or submit information or recordings concerning a child, only if you are the child's parent or legal guardian or you have clear authorization from the parent or legal guardian.

2. Accounts and Account Security

You must provide accurate, current, and complete account information and keep it updated. You are responsible for safeguarding your login credentials and for activity occurring through your account, including use by children, family members, or others you permit to use your household account.

Notify us promptly at truecontractingsoftware@gmail.com if you believe your account has been accessed without authorization.

Accounts are personal and may not be sold, transferred, rented, or shared outside your household unless we expressly permit a family, church-sponsored, organizational, or similar access arrangement.

3. The Service

Bible Family Journal is designed to help families engage with Christian topics and preserve children's spoken responses through private family profiles and AI-generated illustrations.

Features may include prewritten topics or devotional prompts, voice recording, child profile details, illustration generation, saving or downloading illustrations, and related journaling functions.

The Service currently does not provide direct user-to-user messaging or a public social feed. Content associated with a family account is intended to remain private unless a user independently downloads, exports, sends, posts, or otherwise shares it outside the Service.

We may add, remove, restrict, or modify features, content, pricing, eligibility requirements, and technical specifications at any time, subject to applicable law and app-store requirements.

4. Child Profiles and Submitted Information

Child use of the Service must take place through a parent- or guardian-managed account and with appropriate adult supervision.

Depending on the features used, a child profile may include a first name, optional nickname, optional age, optional birthday, voice recordings, optional skin tone, optional eye color, optional hair color, optional hair texture, generated illustrations, and related responses or journal information.

You should provide only information reasonably necessary to use the Service. Do not submit a child's last name, home address, school, precise location, financial information, government identifier, medical information, or other highly sensitive information unless a feature expressly requests it and the Privacy Policy explains why it is needed.

You are responsible for ensuring that submitted information is accurate, appropriate, lawful, provided with any required parent or guardian consent, and consistent with these Terms and the Privacy Policy.

5. Voice Recordings and Processing

Voice recordings are submitted for the purpose of transcribing, interpreting, or otherwise processing a response and generating an illustration or related output. Under the intended operation of the Service, the recording is deleted after the requested processing is completed and is not maintained as ordinary saved journal content.

Deletion may not be instantaneous across every technical system. Temporary processing copies, diagnostic records, security logs, or limited backup copies may persist for a reasonable period where technically necessary, required by law, or needed to investigate fraud, misuse, or security incidents.

6. AI-Generated Illustrations and Other Outputs

The Service may use artificial intelligence and third-party AI providers to generate illustrations or other outputs from user-submitted information. AI outputs are probabilistic and may be inaccurate, incomplete, inconsistent, unexpected, culturally insensitive, visually incorrect, or different from the child's description.

We use technical and operational measures intended to reduce inappropriate or harmful output, but no filtering system is perfect. A responsible adult should review generated content before showing it to a child or sharing it with others.

You must not rely on AI outputs for medical, mental-health, legal, safety, emergency, educational-placement, or other professional decisions.

AI-generated content may resemble content generated for other users, may not be eligible for copyright protection, and may be subject to rights or restrictions imposed by applicable law or a third-party provider.

7. Third-Party AI and Service Providers

We use third-party service providers to operate portions of the Service, which may include cloud hosting, authentication, databases, storage, subscription management, analytics, customer support, and artificial-intelligence processing.

We do not intentionally use your private voice recordings or child-profile content to train AI models owned by the Company. However, third-party providers may process, retain, review, or use submitted information under their own contracts, terms, privacy policies, security practices, and product settings.

Your use of Apple, Google, and other third-party platforms is also subject to their applicable terms.

8. User Content and Permissions

"User Content" means information, recordings, descriptions, responses, images, and other material you submit through the Service. As between you and the Company, you retain any rights you lawfully hold in your User Content.

You grant the Company a limited, nonexclusive, worldwide, royalty-free license to host, copy, transmit, process, modify, and display User Content only as reasonably necessary to operate, secure, support, and improve the functionality of the Service, comply with law, and enforce these Terms.

You represent that your User Content does not violate privacy, publicity, copyright, trademark, contractual, or other rights and does not contain unlawful, abusive, exploitative, or harmful material.

9. Generated Content; Downloading and Sharing

Subject to these Terms and any third-party restrictions, you may download and share illustrations generated for your family for personal, family, church, educational, or other noncommercial purposes.

Once you export or share content outside the Service, we cannot control how recipients, social networks, messaging services, device backups, or other platforms store, copy, use, or redistribute it.

10. Company Content and Intellectual Property

The Service, software, source code, interfaces, designs, trademarks, logos, names, databases, organizational structure, prewritten topics, devotional prompts, instructional text, and other content created or licensed by the Company are owned by or licensed to True Contracting LLC and are protected by intellectual-property and other laws.

Except for the limited right to use the Service under these Terms, no rights are transferred to you. You may not copy, scrape, republish, resell, reproduce, distribute, create a competing database from, train another model on, reverse engineer, or commercially exploit Company Content without prior written permission.

11. Christian and Devotional Content Disclaimer

The Service may provide general Christian devotional content, topics, questions, and family discussion prompts. This content is provided for general informational and faith-engagement purposes and is not a substitute for pastoral counseling, formal theological instruction, medical care, mental-health treatment, legal advice, crisis intervention, or other professional services.

Christian families, churches, denominations, and traditions may differ in interpretation and practice. Parents and guardians remain responsible for reviewing content and deciding what is appropriate for their family.

12. Subscriptions, Free Trials, and Billing

Certain features require a paid, automatically renewing subscription. The current United States price is $2.99 per month, subject to a seven-day free trial for eligible new subscribers.

Subscriptions may be purchased, started, changed, or canceled only by the adult account holder or another adult authorized to act for the family.

The price, currency, taxes, trial eligibility, and billing terms shown in the Apple App Store or Google Play at the time of purchase control if they differ from this description.

Unless canceled before the free trial ends, the subscription automatically converts to a paid monthly subscription and continues to renew until canceled.

We may change subscription pricing, features, or billing periods in the future, subject to required notice, consent, and timing under applicable law and app-store rules.

13. Cancellation and Refunds

You must manage or cancel an Apple subscription through your Apple account and a Google Play subscription through your Google Play account.

Deleting the app or deleting your Service account does not automatically cancel an app-store subscription. You must separately cancel the subscription through the applicable platform to avoid future charges.

Refund eligibility and processing are controlled by Apple, Google, applicable law, and any mandatory consumer rights.

14. Account and Data Deletion

The Service is intended to provide an in-app method to request account deletion. An adult account holder may request deletion of the family account and associated active family data, including child profile information. When an account deletion is completed, the account and associated active family data are permanently removed and cannot be restored through the Service.

Limited residual information may be retained where required for legal compliance, payment records, fraud prevention, dispute resolution, security, or temporary backup-cycle completion.

15. Acceptable Use

You agree not to:

  • use the Service for unlawful, fraudulent, abusive, exploitative, or harmful activity;
  • submit sexual, violent, hateful, harassing, threatening, defamatory, or otherwise inappropriate content;
  • impersonate another person or misrepresent your authority to provide information about a child;
  • attempt to identify, contact, expose, or exploit another user or child;
  • bypass safety filters, usage limits, subscription controls, security controls, or access restrictions;
  • upload malware, automate abusive requests, scrape the Service, reverse engineer the app, or interfere with the Service;
  • use Company Content or outputs to build, train, benchmark, or market a competing service without written authorization; or
  • violate another person's privacy, publicity, intellectual-property, contractual, or other rights.

16. Suspension and Termination

We may suspend, restrict, or terminate access if we reasonably believe you violated these Terms, created a risk to a child or another person, misused the Service, failed to pay required fees, exposed the Service to legal or security risk, or if suspension is required by law or a platform provider.

You may stop using the Service at any time and may request account deletion. Sections that by their nature should survive termination will survive.

17. Service Availability and Changes

The Service may be interrupted, delayed, unavailable, or discontinued because of maintenance, provider outages, internet or device problems, force majeure, legal requirements, security events, or business decisions.

We do not guarantee uninterrupted availability, permanent storage, perfect transcription, successful generation, compatibility with every device, or preservation of any particular feature.

18. Privacy and Security

Our collection, use, retention, and disclosure of personal information are described in the Privacy Policy, which is incorporated into these Terms by reference.

Because the Service may process information about children, the adult account holder must review the Privacy Policy and complete any parental notice or consent process required by law or by the Service before submitting child information or allowing a child to use the Service.

We use reasonable administrative, technical, and organizational safeguards, but no system is completely secure.

19. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, OUTPUTS, FEATURES, AND THIRD-PARTY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, AGE-APPROPRIATE IN EVERY INSTANCE, THEOLOGICALLY ACCEPTABLE TO EVERY USER, OR FREE OF HARMFUL, OFFENSIVE, OR INACCURATE AI OUTPUT.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR FIFTY U.S. DOLLARS (US $50).

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Company and its owners, officers, employees, contractors, and providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your unauthorized or unlawful use of the Service, your violation of these Terms, your violation of another person's rights, or your lack of authority or consent to submit information concerning a child.

22. Informal Dispute Resolution

Before initiating arbitration, either party must send a written notice describing the dispute, the relevant account email, the requested relief, and supporting information.

Notices to the Company must be emailed to truecontractingsoftware@gmail.com with the subject line "Legal Dispute Notice."

The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of a complete notice.

23. Binding Individual Arbitration and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

Except for matters eligible for small-claims court and requests for temporary or injunctive relief involving intellectual-property rights, unauthorized access, child safety, or misuse of the Service, disputes arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration on an individual basis.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. To the extent state law applies, North Carolina law applies without regard to conflict-of-law principles.

The arbitration may be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, or a comparable replacement provider if necessary. Any in-person hearing will occur in Iredell County, North Carolina, unless applicable consumer law requires otherwise.

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

24. Governing Law and International Users

These Terms are governed by the laws of the State of North Carolina and applicable United States federal law, without regard to conflict-of-law rules.

The Service may be made available internationally, but we do not represent that every feature, content item, subscription, or data practice is lawful or appropriate in every location.

25. Changes to These Terms

We may update these Terms from time to time. If a change is material, we may provide notice through the Service, by email, on the website, or as otherwise required by law. The updated Terms will state a new effective date.

26. Electronic Communications

You consent to receive agreements, notices, disclosures, receipts, and other communications electronically, including through the app, website, or email.

27. Miscellaneous

These Terms, the Privacy Policy, the applicable purchase screen, and any additional terms presented for a feature or promotion constitute the entire agreement between you and the Company concerning the Service.

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
